Short Term Holiday Rental named Busselton Family Holiday House, located at 300 Marine Terrace, Geographe, WA, 6280 are subject to the following terms and conditions (last updated September 2023):
1. A contract between the Guest(s) and the owner will come into existence when payment is received, and a booking confirmation is issued showing the confirmed holiday dates. The contract binds the main booking Guest & all the members of the said guest’s party. It is the main booking guest’s responsibility to ensure that all members of the party accept the terms of the contract set out in these terms & conditions of booking. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract & loss of the booking.
2. A refundable damage security deposit is payable prior to arrival - $500.00 – this can be done by EFT cash transfer or Credit Card verification, if not already included within your invoice. In making a booking you accept responsibility for any theft, breakage or damage caused by you, pets or any member of your party and agree to indemnify us in full for any loss that we may incur as a result. The security deposit will be returned within 7 days of the end of the booking, less the cost of any damage/breakages.
3. The balance plus the refundable bond must be paid no later than two weeks before the commencement of your holiday. If the balance is not received by the due date, your booking will be treated as a cancellation and booking availability opened immediately, also forfeiting any fees already paid.
4. All cancellations must be notified in writing.
5. We strongly advise that you take out comprehensive travel insurance to cover cancellations. If you choose not to, you accept responsibility for any loss you may incur due to your cancellation.
6. Your booking will not be cancelled by the owner except in exceptional circumstances beyond our control. Notification will be given of the cancellation as soon as possible and we will promptly refund all payments made for your holiday. Our liability for cancellation will be limited to payments made to us.
7. No parties or events – the maximum number of persons using the accommodation – including the main house and extra unit - at any time must not exceed 8 persons and only those listed on the booking form can occupy the property. We reserve the right to terminate the booking without notice and without a refund in case of a breach of this condition. This occupancy number is a City of Busselton Regulation for this property and is not negotiable.
8. Bookings will not be accepted from persons under twenty-one (21) years of age, Leavers Groups will not be accommodated.
9. The owner reserves the right to refuse a booking without giving any reason.
10. We or our representatives reserve the right to enter the property at any time to undertake essential maintenance or for inspection purposes.
11. Tenancies normally commence at 2.00 pm unless otherwise agreed and guests are required to vacate the rental by 10.00 am on the day of departure. This allows the accommodation to be thoroughly cleaned and prepared for incoming guests.
12. Vaping or smoking anywhere inside the premises will result in immediate termination of occupancy and forfeiture of all payments. This must be strictly adhered to, and any damage or extra cleaning caused by smoking or pets will be at your expense.
13. Pet Rules -A maximum of only 2 small to medium-sized pets are allowed at one time – as agreed upon at the time of booking and considered on its merit. -Guests are responsible for cleaning up after their pets inside and outside around the house and gardens. -Pets should never be left unattended at the property. -Please use your own bedding for your pets, it is not appropriate to utilise provided guest towels or linen for pets.. There is currently a specific pet charge of $50 per pet per stay. This will be shown on your invoice.
14. Damages and breakages – please treat the facilities & accommodation with due care so that other guests may continue to enjoy them. If you notice something is missing or damaged in your accommodation, please let us know immediately so that we can take appropriate action. If there has been any damage or breakages during your stay, we would be grateful if you could report them promptly, especially before check out. The accommodation will be inspected at the end of the holiday & you may be charged for any loss or damage. Small incidental damage may be considered wear and tear – however, your reporting of such incidents is appreciated.
15. Please do not move any furniture from one room to another.
16. Please remove muddy or sandy shoes before entering the house. If coming from the beach, please rinse your feet before entering the house.
17. Please lock the doors and close the windows when you leave the property unoccupied.
18. Please make sure you switch off lights, heating, air conditioning or any electrical appliances when you go out – we’re an eco-friendly holiday home.
19. Please don’t take any bath towels with you to the beach.
20. The owner reserves the right to make a charge to cover additional cleaning costs if the client leaves the property in an unacceptable condition. This additional charge will be taken from the Bond and advised in writing. Current cleaning cost is charged at $45.00 per hour.
21. Please note that if any keys issued are not returned at the end of your stay, then the cost of replacement will be charged to you.
22. The Guest may in no circumstance re-let or sublet the property, even free of charge.
23. The owner shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance in the building, or grounds
24. No compensation will be given for any temporary outage of electricity, gas, water, internet connection or television service.
25. The owners are not responsible for the loss of any personal belongings or valuables of the guest.
26. All inventory must remain in the property and not be taken to another property.
27. Please park vehicles in the designated parking spaces, ensuring cars do not block access to other properties. Parking is limited to 5 vehicles under our Busselton Shire Licence Conditions. Do not park on neighbours' verges.
28. Please respect the neighbouring community and try to keep noise levels to a minimum, especially between 10.00 pm and 8.00 am which is linked to Busselton Shire Holiday Home Code of Conduct conditions applying legally to all our guests..
29. We reserve the right to terminate a holiday without compensation where the unreasonable behaviour of the persons named on the booking (or their guests) may impair the enjoyment, comfort, or health of others.
30. Barbecue – please use the designated barbecue utensils and clean the barbecue after use. Please also regularly empty the drip tray, failure to maintain appropriately may result in a deduction from your Bond.
31. Candles are not allowed inside the house.
32. Check-out at 10.00 am on the date of departure. It is appreciated if guests would empty inside bins, clean dirty dishes and put them away, and leave the property reasonably close to how it was received.
33. Any problem or complaint that a guest may have concerning their holiday must be immediately reported directly to Lisa at bussofhh@iinet.net.au or 0402 284 158 and we will endeavour to put matters right within a reasonable timeframe. Any complaints not reported to us at the time and only reported after the guest has returned from holiday will not be considered by the proprietor.
34. We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.
35. This property is privately owned and is our home. We expect all guests to enjoy the facilities as we do, and treat the property with the same respect that they would with their own house. Other helpful information such as emergency contact details, bin collection days etc. are included in your guest information book at the property.
Items 36. To 43. Represent the Code of Conduct in enforcement for the holiday home located at 300 Marine Terrace, Geographe. The Code of Conduct together with the Certificate of Registration is on display by the front door in the property.
36. (item 1 of code of conduct) An occupant must not engage in conduct at the holiday home that contravenes a) criminal law, or b) The Certificate of Registration
37. (item 2) The maximum number of Occupants permitted at this Holiday Home is 12. No guests are permitted after 10pm.
38. (Item 3) The number of vehicles (including all motorised vehicles and trailers) parked at the Holiday Home must not exceed 5. Each Vehicle used by an occupant or guest of the Holiday Home must be parked within the designated parking bays.
39. (Item 4) Each occupant who enters, uses or occupies the Holiday Home, including any outdoor areas, for example an outdoor entertainment area, deck, balcony, swimming pool or spa, must not act in a manner that could reasonably be expected to cause alarm, distress or nuisance to neighbours adjoining or in the vicinity of the Holiday Home, including but not limited to: - a) violence or threats, b) loud aggressive behaviour including yelling, screaming or arguing, c) excessively loud noise nuisance; and d) overlooking or light spill.
40. (Item 5) Pets occupying the premises: - a) must not be left unattended; and, b) must be managed and not cause a nuisance (including a noise nuisance) to neighbours adjoining or in the vicinity of the Holiday Home.
41. (Item 6) An Occupant or guest of the Holiday Home must not sleep or camp on the site in a tent, caravan, campervan or similar. All rubbish produced by Occupants must be stored in a waste container, and removed weekly.
42 (Item 7) An Occupant must notify the Property Manager or the Managers representative of any dispute or complaint about an Occupants behaviour as soon as possible after the dispute or complaint arises.
43. (Item 8) An Occupant is responsible for the actions of all guests they invite onto the premises during the occupany period, and must ensure guests comply with sections (Items) 1-6 of this code.
